Membership Agreement

MEMBERSHIP AGREEMENT

This membership agreement has been prepared by 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti. (hereinafter also referred to as https://illy.com.tr/ in the agreement) to determine the rules and conditions regarding the use of the illy.com.tr website. This agreement is an integral part of the Privacy and Security Statement.

APPROVAL OF THE AGREEMENT

Filling out the membership form on our site and logging into our site means that you accept and undertake to comply with the provisions of the illy.com.tr membership agreement. The user is deemed to have undertaken to comply with the membership agreement from the moment the membership process is successfully completed.
 
DEFINITION OF SERVICES
 
illy.com.tr offers its members who approve the agreement various communication services (voting, ordering, e-newsletter subscription, notification of discounts) and online shopping opportunities over the internet. illy.com.tr reserves the right to make changes to the services it provides without prior notice.
 
MEMBERSHIP SYSTEM
 
The member will have a "password" that they will determine. The user can change their password at any time. The selection and protection of the password are entirely the responsibility of the user. illy.com.tr is absolutely not responsible for problems arising from the use of the password.
The email address you provided during registration is unique to the member and allows for a single membership; you cannot have two different memberships with the same email address. The "password" is only known by the user.
To connect to services requiring membership, the user must enter the email address and password they entered during registration.
 
OBLIGATIONS OF THE MEMBER
 
The member acknowledges that while benefiting from the services, the accuracy of the information contained in the registration form and the responsibility for any damages arising from inaccurate or incomplete information in situations where this information is required (such as forgotten passwords) belongs to them, and in such cases, their membership may be terminated; that the copyright of the services and software provided by illy.com.tr belongs to 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti., and this software cannot be reproduced or distributed in any way; that they are responsible for their personal opinions, thoughts, expressions, uploaded files, and personal information sent when using the services, and that illy.com.tr cannot be held responsible for these files in any way; that the user will be obliged to compensate for all damages that may arise as a result of such situations; that illy.com.tr will not be responsible for any information messages or files that are lost, incomplete, or incorrectly addressed during the use of the services; that they will not access the services offered by illy.com.tr in any unauthorized manner other than that determined by illy.com.tr and will not alter the software in any way, nor use software that is clearly altered, and in cases of non-compliance with the aforementioned articles, they will pay all material and moral damages that 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti. may incur; that 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti. will not be responsible for damages that may arise from unauthorized reading of member data; that they will not send threatening, immoral, racist messages or messages contrary to the Laws of the Republic of Turkey and international agreements; that they will not send information or programs that will harm the information or software on other users' computers; that any record or material obtained by using illy.com.tr services is entirely the user's responsibility, and they are solely responsible for any malfunctions, data loss, and other losses created on the user's computer; that they will not demand compensation from 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti for damages they may suffer due to the use of the service; that they will not use the services for commercial or advertising purposes without permission from 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti; that illy.com.tr can monitor the entire system at any time or continuously, and if they act contrary to the rules, illy.com.tr has the right to intervene, remove the member from the service, and terminate the membership; that illy.com.tr can use its own system for commercial purposes; that they will not post information that is prohibited by law and will not send chain mail, software viruses, etc., that they are not authorized to send; that they will not record or misuse personal information belonging to others; that they are personally responsible for all transactions made with the email address they provided during registration; that they must complete the purchase process on the system via a valid credit card or by wire transfer/EFT; that they cannot shop on the system if their credit card validity is not approved or if wire transfer/EFT payment is not made; that they must show a valid ID card if requested during product delivery, allow the relevant identity information to be recorded, and sign in the relevant places, and if they do not sign, the product cannot be delivered to them; and if the product is received by another person, the person receiving the product must sign the document that the person delivering the product on behalf of illy.com.tr will present, stating that "they know the person who sent the product to them", and if the document is not signed, the product will not be delivered and therefore the order will be deemed not to have taken place.

POWERS OF illy.com.tr
 
illy.com.tr may temporarily suspend or completely stop the operation of the system at any time.
2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti will have no responsibility towards illy.com.tr members or third parties due to the temporary suspension or complete cessation of the system.
illy.com.tr may prevent the user from logging into the system or obtaining a new password without stating a reason, even if the user has entered their username and password correctly.
All intellectual and industrial property rights of information, documents, software, designs, graphics, etc. produced by illy.com.tr and/or purchased from external sources belong to illy.com.tr.
Sales on illy.com.tr are limited to stock. illy.com.tr may not deliver products that are out of stock, and may cancel the order and refund the order amount to the customer's account.
Information, documents, software, designs, graphics, etc. produced by members and uploaded to the system voluntarily for publication cannot be used without permission.
The authority to change the price and product feature information of the products offered for sale on illy.com.tr belongs exclusively to illy.com.tr. In case of an error in the price and product feature information, illy.com.tr may correct the error and deliver the product or cancel the order and refund the order amount to the customer's account.
If it is stated that shipping will be free for products sold together within a single order, and one of the products is returned, the shipping fee for the non-returned product will be charged to the BUYER. The SELLER reserves the right to deduct the relevant shipping fee from any refund payments to be made to the BUYER, if any.  
illy.com.tr may allow the member to switch to other websites. In this case, illy.com.tr is not responsible for the content of the sites the member will switch to.
 
2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti may make changes in the implementation of this agreement, or it may change existing articles or add new articles. illy.com.tr may convert services that do not require membership into services that require membership over time, open additional services, partially or completely change some of its services, or make them paid.
 
 VALIDITY OF RECORDS
 
The member accepts and undertakes that in disputes that may arise from this agreement, the books of 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti, microfilm, microfiche, and computer records will constitute valid, binding, definitive, and exclusive evidence in the sense of Article 193 of the HMK, and that this article is in the nature of an evidence agreement. 2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti accepts, declares, and undertakes that it waives in advance its right to object to any records and its right to propose an oath regarding their proper keeping.
 
APPLICABLE PROVISIONS
 
In disputes that may arise regarding this agreement, the provisions of this agreement will be applied first, and in cases where there is no provision, the current Turkish legislation will be applied.
 
AUTHORIZED COURTS AND ENFORCEMENT OFFICES
 
The Courts and Enforcement Offices of the Republic of Turkey will be authorized to resolve any disputes that may arise from the implementation of this agreement.
 

EFFECTIVENESS
 
After the user fills out the registration form and receives a password, this agreement comes into force indefinitely between the parties.
 
TERMINATION
 
2F Gıda Pazarlama İthalat İhracat Sanayi Tic. Ltd.Şti may terminate this agreement unilaterally at any time.
